Ness Computing, Inc. ("Ness," "we," "our" and "us") knows that your privacy is important to you and that's why we want to be very clear about the ways in which your data may be used or shared. This Privacy Policy describes the information that Ness collects when you use the Ness service (“Service”) and how this information will be used and disclosed. The terms of our Privacy Policy apply to all users of our Service. If you do not agree with the terms of our Privacy Policy, you should immediately stop using our Service.
Highlights
The Service respects the privacy models of third-party services such as Facebook, Foursquare, etc. For example, on Foursquare, as you can only see checkins from your friends on Foursquare's website, you can only see checkins from your Foursquare friends on Ness.
Information you share with the Service is available only to other users of the Service, unless we ask for your explicit consent.
Personal Information We Collect And How We Use It
You may use our Service as follows. First, if you are logged out of our Service, we may collect anonymous information by using cookies. Second, you may log in to your social networking service account, as follows. The following information from your Facebook account is collected by us: your name, profile picture, gender, networks, user IDs, friends and any other information requested when you are connected with Facebook in our Service. After logging into Facebook, you may associate an account for Foursquare or Gowalla. For Foursquare or Gowalla, we collect information, including but not limited to the following: your name, email address, profile picture, friends, checkins, friends’ checkins and only for Foursquare, tips.
If you use our Service, we automatically collect information about you, including your Internet Protocol address and usage history in the application as well as information about your location. We collect information about you to personalize and enhance your experience using our Service as well as to improve our Service.
Throughout our Service, each of you and your social connections from third party social networking services will be able to see the activities of the other. A social connection may only be removed through the third party social networking service, not through our Service. Users who use third party social networking services should be aware that when they voluntarily disclose information about themselves, the information can be read and used by others. We make no representations and undertake no obligations as to the security or use of information you voluntarily include when submitting content.
We reserve the right, but have no obligation, to monitor information, comments or other content that you voluntarily disclose and post to our Service. We reserve the right to remove any such information or material for any reason or no reason, including without limitation if in our sole opinion such information or material violates, or may violate, any applicable law or our Terms of Use or End User License Agreement or to protect or defend our rights or property or those of any third party. We also reserve the right to remove information upon the request of any third party.
You should make sure you are comfortable with the information that a third party social networking service may make available to us by visiting the service’s privacy policy and by modifying your privacy settings directly on that service. Any information we receive through a third party social networking service may be used as described in our Privacy Policy.

Information may be disclosed to third parties in accordance with our Privacy Policy.
Third Party Service Providers
We may use third parties to perform services in connection with our Service. We may share information about you with them for the purpose of performing the services they are required to perform.

such as advertisers and content distributors (for example, to facilitate promotions on our Service), or in public communications (for example, in marketing materials).

if the ownership of all or substantially all of our business otherwise changes, we may transfer your information to a third party or parties in connection therewith.
Investigations.
We reserve the right to investigate abuses on our Service and enforce and apply our Terms of Use and End User License Agreement.

Cookies and Web Beacons
We use cookies, web beacons or other technologies to track your usage pattern on our Service. A cookie is a text file, consisting of a series of random numbers and letters that serves as a pseudonymous identifier for your application, but does not identify you. We use web beacons in HTML-based emails sent to you to track which emails are opened by recipients.
Ness currently uses Google Analytics to better understand who is using the Service and how people are using it. Google Analytics uses cookies to collect and store anonymous information such as time of visit, interactions with the application such as button clicks, time spent using the application, and Internet Protocol address. We use this information to improve the Service and make it appealing to as many users as possible.
Security
We take significant steps to protect information you transmit to our Service, but cannot guarantee that these measures will prevent a third party from circumventing them or where an error may occur in the provision of our Service. Please keep in mind that no Internet transmission is 100% secure. Any information you provide on public areas of our Service may be accessible by a third party. We recommend that you use caution whenever submitting your information online.

Our Service may contain links to Websites that we may not own or operate. We neither can control nor are responsible for the privacy practices or content of these Websites. We encourage you to read the privacy policies of every Website that collects personally identifiable information. Our Privacy Policy applies solely to information collected on our Service.
Access
We want to keep your information accurate. You can correct or update the information you have provided. You can stop using our Service by deleting the application. You may contact us at help@likeness.com to request a change to your information or if you have questions about your Ness user account.
Children
Our Service is not intended for use by children under age 13 and we do not knowingly collect personal information from children under age 13. If you have reason to believe that we may have accidentally received personal information from a child under age 13, please contact us immediately at help@likeness.com.
Policy Changes
We may modify, alter or update this Privacy Policy at any time, so we encourage you to review this Privacy Policy frequently. We will not provide individual notice to you of changes to this Privacy Policy, but when we make updates to this Privacy Policy, we will update the date at the top of this Privacy Policy.
